Tamil Nadu's approach is closer to Maharashtra's than Delhi's or Karnataka's: stamp duty is commonly calculated at around 1% of the sum of the total rent and deposit over the agreement's term, with a separate registration fee of roughly the same order.

While the Registration Act's one-year threshold technically applies here too, Tamil Nadu courts have consistently held that an unregistered rent agreement can't be produced as evidence in a rent dispute — so registering, even for an 11-month agreement, is the practical norm rather than the exception.

The Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017 also requires registration of the agreement with the local Rent Authority within a short window of execution, separate from the stamp duty registration itself.

Is it worth skipping registration in Tamil Nadu to save on cost?

Generally not — Tamil Nadu courts have repeatedly refused to admit unregistered rent agreements as evidence in disputes, which undermines the entire point of having a written agreement. The registration cost is usually small relative to what's at stake if a dispute arises later.

What is the separate Rent Authority registration about?

Since the 2017 Tamil Nadu tenancy law, landlords are required to register the tenancy agreement with the jurisdictional Rent Authority within the timeline the Act specifies, in addition to the usual stamp duty and sub-registrar registration — check the current process with your local Rent Authority office.
