Stamp duty and registration, by state

These rules genuinely differ by state — not just the duty rate, but whether registration is mandatory at all for a short-term agreement. Pick your state for the specifics:

Frequently asked questions

Why do most rent agreements run for exactly 11 months?

An 11-month term keeps the agreement below the one-year threshold at which registration becomes compulsory under the Registration Act in most states — so it can be notarized instead, which is faster and cheaper, then simply renewed. Maharashtra is the main exception, where registration is mandatory regardless of term.

Do I need to register this agreement for it to be valid?

It depends on your state and the term. Below one year, most states treat a notarized agreement as sufficient for everyday use, though an unregistered agreement can be harder to rely on as evidence in a dispute — Tamil Nadu and Maharashtra are stricter about this even for short terms. See your state's page above for specifics.

Can I use this for a commercial lease instead of a residential one?

Yes — switch "Property use" to Commercial. For a high-value or long-term commercial lease, it's worth having a lawyer review the final agreement, since commercial leases often carry more negotiated terms (lock-in periods, escalation clauses) than this general template covers.

Is a security deposit refundable by law?

There's no single national cap on deposit amounts, and refundability depends entirely on what the agreement says — this template treats it as fully refundable, adjusted only against dues or damage, which is the common default across most states.
